Conservatorships
A conservatorship is a court proceeding to appoint someone to manage the
finances, personal affairs, or both, for an adult who cannot manage his or her
own affairs. Conservatorships are also used to protect people who cannot
resist the fraud or undue influence of others. In addition, once
developmentally disabled children reach the age of majority, limited
conservatorships are available so that someone may be appointed to take care of
the matters that the disabled person is unable to take of personally.
If there is a conservatorship of the estate, meaning that someone has been
appointed to manage finances, the conservator must periodically account to the
court for all expenses and income of the conservatee.
Conservatorships may be avoided if the incapacitated person has a proper estate
plan; however, in cases of physical or financial abuse, it may still be
advisable to establish a conservatorship.
Mr. Jones represents conservators and potential conservators in all aspects of
conservatorship proceedings and works closely with conservators to ensure that
they are meeting their fiduciary obligations to the conservatees.
