Probate
Probate is the process whereby the court determines the validity of a
decedent's will, or, if the decedent did not leave a will, appoints someone to
administer the decedent's estate. The person administering the estate,
called the "personal representative," must then inventory the decedent's assets. The decedent's
assets must then be appraised, and the decedent's creditors must be given notice
to make claims against the decedent's estate. Once these things occur, the
personal representative must prepare an accounting that must be approved by
the court.
Complicated estates or estates involved in litigation may take years to
complete; however, most estates may be administered in approximately one year.
